Terms of Service

These Terms of Service govern access to and use of Cassius Technology’s website, conversational AI services, communications, and related offerings.

SMS consent is separate and voluntary. Agreement to these Terms does not, by itself, constitute consent to receive marketing text messages. Where consent is required, it must be provided through a clear, affirmative opt-in and is not a condition of purchase.

1. Acceptance of Terms

By accessing or using our website or services, you agree to these Terms and our Privacy Policy. If you use the services for a company or other organization, you represent that you have authority to bind that organization. If you do not agree, do not use the services.

2. Services

Cassius Technology provides conversational AI and related technology that may answer calls, respond to messages, provide information, collect details, schedule or route requests, integrate with business systems, and assist with customer-service workflows. Specific features, service levels, pricing, limits, and responsibilities may be described in an order form, proposal, statement of work, or other written agreement.

AI-generated responses may be incomplete or inaccurate. Customers are responsible for reviewing configurations, approved knowledge, workflows, disclosures, and high-impact decisions and for maintaining appropriate human oversight.

3. Eligibility and Account Responsibilities

You must be legally capable of entering into these Terms. You are responsible for information supplied to us, maintaining account and credential security, activity under your account, and promptly notifying us of suspected unauthorized use.

4. Acceptable Use

You may not use the services to:

  • Violate any law, regulation, industry rule, court order, or third-party right.
  • Send unlawful, deceptive, unwanted, abusive, discriminatory, or fraudulent communications.
  • Misrepresent identity, impersonate others, or conceal the nature or source of communications.
  • Upload malicious code, interfere with service operation, probe security, or gain unauthorized access.
  • Process information you do not have authority or a lawful basis to use.
  • Use the services for emergency dispatch, life-safety decisions, or other high-risk activities unless expressly agreed in writing with appropriate safeguards.

5. SMS and Email Messaging Terms

SMS messages are sent only to people who deliberately and affirmatively opt in. An opt-in may occur by selecting an unchecked SMS consent option, initiating an SMS exchange where a response has been requested, or using another documented method that expressly authorizes the applicable messages. Providing a telephone number alone does not constitute consent or enroll a person in an SMS program. For Cassius Technology AI Receptionist Alerts, authorized business customers opt in through our public SMS Consent page by personally sending START to 307-458-1248.

If you affirmatively opt in to receive SMS or email communications from Cassius Technology or an AI receptionist acting on behalf of a disclosed business, you consent to receive communications within the scope described at the point of opt-in. Communications may include customer-care responses, requested information, appointment reminders, service notifications, follow-ups, account messages, or promotional messages where separately authorized.

  • Reply STOP to cancel SMS messages.

  • Carriers are not liable for delayed or undelivered messages.

Consent to receive marketing SMS or email is voluntary and is not a condition of purchasing goods or services. You may revoke SMS consent at any time by replying STOP and may unsubscribe from marketing emails using the unsubscribe link provided. After an opt-out request, we may send a confirmation and will stop applicable messages except as permitted by law.

Mobile phone numbers, SMS opt-in information, and messaging consent data will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.

6. Customer Compliance Responsibilities

Customers using Cassius Technology to communicate with their own end users are responsible for their messaging content and campaigns, obtaining and documenting all required consent, honoring opt-outs, providing legally required notices, identifying the sender, and complying with applicable laws, carrier requirements, and messaging-platform policies. Customers may not purchase, sell, transfer, or share messaging consent.

7. Intellectual Property

Cassius Technology and its licensors retain all rights in the services, software, designs, documentation, trademarks, and technology. Subject to applicable agreements, customers retain rights in content they supply. You grant us the limited rights necessary to host, process, transmit, and use supplied content to provide and support the services.

8. Fees and Payment

Fees, billing schedules, usage limits, taxes, renewals, and cancellation terms will be stated in the applicable order or service agreement. Unless otherwise stated, fees are nonrefundable except where required by law or expressly agreed in writing.

9. Availability and Changes

We may update, modify, suspend, or discontinue parts of the services. We do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party systems, telecommunications networks, internet conditions, and events outside our reasonable control may affect availability.

10. Disclaimers

To the maximum extent permitted by law, the website and services are provided “as is” and “as available.” Cassius Technology disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing or usage. We do not warrant that AI output is always accurate, complete, or suitable for a particular decision.

11. Limitation of Liability

To the maximum extent permitted by law, Cassius Technology will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from the services. Our aggregate liability for claims related to the services will not exceed the amount paid to Cassius Technology for the applicable services during the six months preceding the event giving rise to the claim, unless a different limitation is stated in a signed agreement or prohibited by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Cassius Technology and its personnel from claims, damages, liabilities, and expenses arising from your content, your use of the services, your messaging campaigns, your violation of these Terms, or your violation of law or third-party rights.

13. Termination

You may stop using the website at any time. We may suspend or terminate access for violation of these Terms, legal or security risk, nonpayment, or conduct that could harm users, third parties, or the services. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Unless another written agreement provides otherwise, disputes will be brought in courts of competent jurisdiction located in Wyoming, and the parties consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms periodically. Revised Terms will be posted on this page with an updated date. Continued use after the effective date of revised Terms constitutes acceptance, except where additional consent is required by law.
